COMPUTER EQUIPMENT SERVICE AGREEMENT
STORAGE OF YOUR EQUIPMENT IS STRICTLY LIMITED IN TIME; STORAGE; FORFEITURE:
Any equipment left for more than 14 days after invoice date will be charged a $10/day storage fee.
Customer shall pick up computer or any other equipment within 60 days of the invoice date or the items will become the property of MacPro-LA, LLC without further notice.
Customer agrees to all terms, conditions, and company policies, and agrees to pay any expenses, fees, materials, and labor in a timely way, picking up any equipment to avoid storage fees and/or forfeiture of the equipment as set forth above.
Customer hereby authorizes MacPro LA, LLC to perform work on Customer’s hard drive and/or any other technical service to computers, hard drives or other equipment brought in for work.
Customer understands the necessity of backing up all data on all equipment and warrants that each device placed in MacPro-LA’s custody have been fully backed up prior to bringing each item of equipment to MacPro-LA’s shop for any type of work.
CUSTOMER SHALL ADVISE MACPRO-LA, LLC OF ANY PRE-EXISTING DAMAGE TO EACH PIECE OF EQUIPMENT AT THE TIME OF PRESENTING ANY ITEM OF EQUIPMENT FOR ANY KIND OF WORK.
MacPro-LA, LLC reserves the right to reject service to anyone at any time, save only “protected” classes of persons, as to whom no discrimination shall be leveled on an unlawful basis.
LIMITATION OF WARRANTY TO SERVICE PROVIDED:
On all computer repairs, sale of computers, upgrades, and troubleshooting, MacPro-LA, LLC only warranties the “service” that was performed for a period of 90 days from the invoice date. There is no warranty for any software issues created and/or caused by the end user.
MacPro-LA, LLC’s hardware installation warranty is for 90 days from the invoice date. Warranties on the hardware itself, if any, are solely provided under the equipment manufacturer’s warranty. MacPro-LA, LLC offers no warranty on hardware or equipment itself.
MacPro LA, LLC’s warranties specifically exclude and therefore do not cover any misuse, tampering, abuse, fire, theft, accidental damage, surges, spikes or burnouts.
MacPro LA, LLC is not responsible for tutoring or teaching you anything about your computer.
MacPro LA, LLC will make every reasonable effort to protect your data. However, it is possible that data can be lost due to factors beyond our control. . MacPro LA LLC will not be held responsible in any way for lost data or any loss of revenue or income resulting from such loss. As set forth above YOU, the customer, are responsible for backing up your data, and expressly warrant that you understand this and have backed up your data before bringing in each piece of equipment for work. MacPro LA, LLC may back up your data for you at your request for a fee.
DATA AND SOFTWARE LOSS UPON FORMATTING HARD DRIVES:
The customer understands that ALL DATA WILL BE LOST if we have to format your hard drive (i.e. when installing a fresh operating system) and it is not backed up, including any applications that are not included with your operating system, and software that you do not have legal installation discs for. You also understand that during the course of service, data (personal files) can become corrupt or unusable, in such case you will not hold MacPro LA, LLC responsible.
We perform custom installation, repair and upgrade work to the specific order of each customer. There are no returns, refunds or exchanges.
MacPro-LA, WILL UNDER NO CIRCUMSTANCES BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM SERVICES PROVIDED OR UNDER ANY OTHER LEGAL THEORY, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE; LOSS OF ACTUAL OR ANTICIPATED PROFITS (INCLUDING LOSS OF PROFITS ON CONTRACTS); LOSS OF THE USE OF MONEY; LOSS OF ANTICIPATED SAVINGS; LOSS OF BUSINESS; LOSS OF OPPORTUNITY; LOSS OF GOODWILL; LOSS OF REPUTATION; LOSS OF, DAMAGE TO, OR CORRUPTION OF DATA; OR ANY COSTS OF RECOVERING, PROGRAMMING, OR RESTORING ANY PROGRAM OR DATA STORED OR USED WITH YOUR PRODUCT AND ANY FAILURE TO MAINTAIN THE CONFIDENTIALITY OF DATA STORED ON YOUR PRODUCT. IF ANY PRODUCT SHOULD BE DAMAGED OR LOST WHILE IN CUSTODY, MacPro-LA LIABILITY WILL BE LIMITED TO THE COST OF REPAIR OR REPLACEMENT OF THE AFFECTED PRODUCT. OTHERWISE, MacPro-LA LIABILITY FOR ANY AND ALL DAMAGE SHALL IN NO EVENT EXCEED THE PAYMENTS RECEIVED BY MacPro-LA FOR SERVICES PROVIDED PURSUANT TO THESE TERMS.
Return Of Hard Drives And Computer Equipment: By signing for receipt of the repaired equipment below, Customer agrees that Company has delivered (a) all transfer hard drives and recovered data to Customer, and/or (b) computer equipment to Customer, and that all such equipment has been serviced and otherwise repaired to Customer’s full
and complete satisfaction.
